An employee claimed that as a sales person was entitled to 30+% of the gross revenues of the company. The expert wrote a report and then testified that there was no basis for an economic model in pay systems whereby a single employee could receive 30+% of the total revenues of this company. This was supported by external market research. The company was a start up experimenting in very complex financial transactions with many complex variables. The jury returned after a very short deliberation and split the asked for damages right down the middle. Most important lesson from this case to employers is to document promises of sales commissions and profit sharing to employees.
