Nadel was asked to prepare an expert report and testify in a case where the President of a Subsidiary had been advised that upon the sale of the company he would share in the profits of the sale in excess of a certain sale price. The company was offered for sale twice, and each time the owner indicated that upon sale there would be a substantial payout. In the third instance when the company was sold for substantially more than asking, the owner reneged on any payout. The expert's role was to establish the pattern of the practice of sharing profits with key executives in general industry. After testifying, the case was settled satisfactorily to the Division President.
Important to this case was the discovery process and the research process to demonstrate that the pattern of sharing gains in this company was similar to the patterns of sharing in gains in general commerce and industry.
