- Assistance in Developing Case Strategy. This includes discussing common or unusual patterns related to HR or management practice and developing a principle for the case.
- Developing a "discovery" plan for the lawyer to request of the other side. Often this discovery and then further discovery is key to the case as the analysis and detective work of uncovering key data can be a turning point in the case. Knowing Human Resources practices intimately allows for an expert to dig deep for discovery information.
- Doing research and market analysis to compare reasonableness or unreasonableness of practice and of metrics. Courts, juries and the other side are persuaded by hard facts that can overpower other soft facts.
- The articulation of an opinion or opinions of a qualified individual. The expert report document itself is often the turning point between trial and settlement.
- Expert Testimony in a Court of Law or at Arbitration. Important are presence of mind, answering only the question asked, and being able to state an opinion, based on research and expert knowledge in a clear and concise manner.
